More then 5,7 thousand foreigners staying illegally in Poland have already applied for abolition (amnesty for irregular migrants). The Office for Foreigners informs that by the 18^th April 2012, applications of 5574 persons have been registered. Within similar actions in 2003 and 2007/2008, applications of 5541 foreigners were registered (3508 applications in 2003 and 2033 applications in 2007/2008). Thus, the number of people applying for abolition this year exceed the number of applications of both 2003 and 2007/2008 actions.

Most of all applications have been submitted to mazowiecki voivode, as well as to to łódzki, lubelski, śląski, dolnośląski, wielkopolski i podlaski voivodes.

For abolition most often apply citizens of: Vietnam, Ukraine, Pakistan, Armenia, China, Egypt, India, Russia, Belarus and Georgia.

The majority of applicants (more than 97%) are foreigners who have been staying in Poland for an uninterrupted period from at least 20^th December 2007 and on 1^st January 2012 were in Poland illegally ( pursuant to article  1 paragraph 1 of “abolition act”).

Less than 3 %  of applicants are foreigners who applied for refugee status in the past and:

• who have resided in the territory of Poland for an uninterrupted period from at least 1 January 2010, who prior to that date were granted a final decision on rejection to award the refugee status along with a judgement to expel them and whose stay within this territory was illegal on 1^st of January of 2012 (pursuant to article 1 paragraph 2 of “abolition act”);
• against whom proceedings were being carried out on 1 January 2010 for the award of the refugee status that were instituted due to repeated application (pursuant to article 1 paragraph 3 of “abolition act”).

Up to now, 1500 of persons have legalized their stay in Poland

On March 21st the international the Campaign to End the Immigration Detention of Children was officially launched at the 19th Session of the UN Human Rights Council attended by governments, UN bodies and NGOs from around the world. The Halina Nieć Legal Aid Center joined to NGO coalition, now we are inviting you to support us ! Below is the campaign clip, watch it, share it and sign the petition against child detention.

The International Detention Coalition, which the Halina Nieć Legal Aid Center is a member of, launches a global campaign to end the immigration detention of children on 21^st march 2012 . The campaign will be conducted at the UN Human Rights Council and in a number of countries all over the world, among others in Poland. The campaign is funded from the sources of the Diana, Princess of Wales Memorial Fund and Wheeler Foundation.

The campaign focuses specifically on children placed in detention centers (in Poland Guarded Centres for Foreigners), because of their illegal stay. Preventive measure in form of placing children in detention centers is applied even towards children seeking for refugee status or other forms of protection. The Halina Niec Legal Aid Center and other coalition members state that the immigration detention of children, as a very harmful measure, should be eliminated and replaced by the alternative preventive measures.

The HNLAC will inform on its website and Facebook profile about activities undertaken during the campaign.

The campaign starts with a video petition by formerly detained children for children in detention. Afterwards each child will gain possibility of express on why children do not belong in detention. We present a new publication of the Legal Intervention Association and the Polish Migration Forum on Policy of selecting and locating refugee centres. Analysis and recommendations (the document is available in Polish). The document is a result of a project funded by The Stefan Batory Fundation. It consists of research results of tender documents from recent 5 years conducted by Office for foreigners, interviews with experts working with asylum seekers, analysis of the functioning of the refugee centers in Poland; comparative report on the functioning of the refugee centres in chosen EU member states and legal opinion on Public Procurent Law in the context  of investment of funds for refugee centres.  The chapter Analysis of functioning of centers for foreigners applying for refugee status or asylum in selected locations was prepared by Paulina Nikiel, from the HNLAC’s team.
